As per a recent decision by the Kerala High Court, primary cooperative societies undergoing winding-up proceedings under Section 71 of the Kerala Co-operative Societies Act, and are managed by a liquidator appointed under Section 72, cannot be permitted to nominate any person on its behalf to participate and cast vote in any other society.
The court underscored that Section 72 clearly delineates that when a liquidator is appointed, he does not become the society itself. The society maintains its separate identity from the liquidator. Therefore, the liquidator, either himself or through any nominated representative, cannot cast a vote on behalf of the society in managing committee elections.
