In a significant international trademark infringement case, the Delhi High Court has ruled in favor of Amul, India’s largest dairy brand, against Italian company Terre Primitive. Terre Primitive had been selling cookies and chocolate-covered biscuits under the name ‘Amuleti,’ which closely resembled Amul’s long-established established trademark.
While welcoming the decision, Jayen Mehta, Managing Director of GCMMF described the decision as an important precedent in protecting indigenous brands from international trademark violations.
The Gujarat Cooperative Milk Marketing Federation (GCMMF), which owns the Amul brand, filed the lawsuit through its counsel Abhishek Singh. Singh argued that Amul is a household name in India with a strong global presence. He also argued that Amul ranks 8th among the world’s top dairy companies. He claimed that Terre Primitive had “blatantly” imitated the design, style, and representation of the Amul trademark by merely adding the suffix ‘eti’ to the name.
Justice Mini Pushkarna issued an injunction, restraining the Italian company from using any mark similar to ‘Amul’ and ordering them to remove all infringing products from their website. Additionally, Meta Inc. (Facebook) was directed to block or delete any social media accounts linked to the Italian firm that promoted the infringing products.
